Najeeb Jung interview decoded - Curious case of Delhi ACB fight

There is a recent judgement of Delhi High court and Najeeb Jung said in an interview that ACB Delhi cannot file cases against Central Government Employees.



  1. Who can appoint Civil offficers in Delhi?
    Interviewer :
    "Who has the power to appoint chief secretary etc, the Delhi CM or You?"

    Najeeb Jung at 2:23 --->  "Prior to 1 and a half years, we were use to "suggest a panel" to the ministers, but now we do not feel the need and appoint directly "

    Observe: So previously LG used to provide a list of officers and government/minister could choose from them. Now LG wants to appoint directly.

    Why? Why such dictator attitude? Why not let Delhi government choose which officer they want?

    Conclusion: Najeeb jung is certainly NOT CONSULTING with Delhi govt NOW. Which he himself said that previously used to happen. (These are his own words) Is this NOT A CLEAR case of vendetta!
  2. ACB's Functioning effectively?

    at 2:23 in the interview video 


    Mr Jung's CLAIM : ACB exists and working effectively.

    COUNTER Fact: 
    • When Kejriwal was controlling ACB, more than 100 cases were filed.
    • Now ever since ACB was hijacked hardly 10 cases are filed. in over 6 months.
    • Delhi Govt has sent more than 50 cases along with proof but not a single case has been filed by ACB for those.

    Conclusion : 
    ACB is NOW hijacked and reduced to a non-functioning dummy body. Only to protect all central ministers/officers. Esp BJP's own and even Sheila Dixit! Its not only a waste of taxpayer's money but also increasing corruption in Delhi.
  3. Claim: Delhi CM cannot set up Commission of Enquiry
    Jung said that Delhi government does not have power to set up commission of enquiry.

    FACT:
    Here is a screenshot when

     Sheila Dixit had set up a Commission of Enquiry to probe child abuse in February 2012:


    And
    Again Sheila Dixit and Delhi government set up a commission of enquiry in 2011 



    Quote from above newspaper article:
    "71 people were killed — on Monday deposed before the Delhi government-appointed Commission of Enquiry (CoI) headed by retired High Court judge Lokeshwar Prasad."
    Conclusion:Do I need to say anything again? If Delhi CM could set up enquiry in 2011, 2004 then why not now?


  4. Mr Jung Claims : ACB cannot File Cases against central government employees

    Again this is complete farce if you check history

    Here is as an example of case filed by ACB against employees of departments that come under central government:

     ACB files chargesheet in AIIMS (which comes under Ministry of health )

    If you go through more case history, you can find even more cases where ACB Delhi acted against departments of central government employees. 

More interesting observations 


Is Delhi a UT?
The biggest difference between a usual union territory and Delhi is Delhi has its own ACT National Capital Territory of Delhi Act, 1991 

It will be foolish to say that Delhi is a UT. Here are some of the reason it can't be a UT:

  • Delhi population is HUGE!
    Delhi is home to 1.5 crore people. That's equal to population of many states! not just cities! Such a high population needs specialized governance and not usual UT thing.
  • Delhi size is not of a UT
    Delhi's size is humongous if you compare it with usual UTs.
    There's a reason why NCT act was formed and a council of ministers were appointed in 1991.

    The reason is simple,
    Delhi is ever growing in size and in population. If Delhi CM's role was limited to roads, education and health on smaller level.  Then these could have addressed by just having a Mayor or municipal corporation.

    Delhi due to its size and population demands more work. It has more problems which needs to be addressed by a bigger team of representatives of people! MP's won't suffice!

    Delhi has 8 Member of parliament. Other states hardly have 1. And None of Union territories have more than 1.

     THIS IS PRECISELY WHY NCT of Delhi act was brought in 1991!
  • Delhi is more than a city with satellite towns
    Think about is, Delhi has many satellite towns like Mehrauli. Is it not good that Mehrauli residents get an elected representative who has control over Delhi police to address local issues? Central government is in place for international issues.

    I wonder if home minister of India will have the time and priority to check out what's happening in Burari, Lado sarai, Mehrauli vs what's happening at china border?

    Delhi being capital, of course the central government can deploy army/special commando forces to work with Delhi police. But not having any security police for local Delhi ites is a sad state of affair which needs to be addressed.

    Delhi needs attention and specialised treatment. It is a complex city with several problems and law and order issues. MCD and Delhi police is ranked top in corruption cases in recent history.

    It is awkward that Mr Najeeb Jung is behaving like a dictator by not consulting the counsel of minister and stating facts which are proven wrong, out in open! By not consulting or taking advice from CM is Najeeb Jung not violating the constitution? 

Delhi is more than UT is explained by simple fact that Delhi has 7 MPs (Member of Parliament)while many states have only 1. A state like Goa has only 2. So Delhi definitely needs more work than these states. And No other UT has more than 1 MP.

So it is utterly "laughable" to call Delhi a UT! Delhi is far from UT, more complex, bigger, larger in space and number! Delhi people are facing a lot of problems. And central government is following the orthodox vendetta politics of worst order.

I think i will end my article here.

I request every Indian citizen to respect the spirit of constitution. In a democracy people's power is supreme and NOT OF A CIVIL SERVICE OFFICER! No matter which political party you support, let us not kill the spirit of democracy!

Solution to Delhi traffic problems - Its not the cars ...


Oh! We thought cars cause mot pollution? Right? NO! Wrong!

According to a study published in Hindustan Times, car emission is responsible for only 7 of pollution.

The MAJOR culprit is the dust!

I am an ardent AAP supporter, as you can see in my blog. I have supported them on almost every step.

But i don't support people but only ideas. So i think this time AAP has got it a little wrong!

I do appreciate the odd/even cars plan in Delhi. But it does not target the real root cause!

Government need to understand that if they focus on removing dust then half of the problem will be solved.  Without causing much trouble to the public.


My suggestions 



There can be quick measures to reduce pollution quickly!


- Human volunteers to remove dust
Simply give empty katta/cement covers to volunteers who will fill it with sand and keep it at at the same spot. At one end of the road instead of waiting for months for vaccuum cleaner. If the sand is trapped in cement katta (cover) it will not spread in air. This alone can change the situation very quickly! 

I am sure many volunteers will do this service for free!! I will come to Delhi myself and try to fill at least 10 such dust on road in empty cement bags. 

Change office timings
Encorage small businesses etc who do not have public dealing to consider change of timing. 

Changing office timings will reduce congestion and eventually peaking of pollution at office hours. 


Regulate industries
Conduct an audit of which industries causing most pollution. Ask them to work in night shifts or shift their base to outside Delhi 


Transplant trees
Growing trees takes time, implant them from neighboring areas so that we can have quick source of oxygen in key areas.

Delhi Janlokpal 2015 should take cues from Uttarakhand Lokpal

Delhi Janlokpal will be tabled in Assembly tomorrow.


There are four points raised by critics. 

1. Appointment of Lokpal to be done thru in an open manner by involving the public in search process.

2. Final selection of Lokpal to be done by a committee where independent, non-political and non-govt appointees have majority

3. A special investigative agency to be created by or controlled by Lokpal.

4. Jurisdiction of Lokpal to be extended to all the functionaries of the relevant govt.

Let's discuss each issue one by one:

Point number 1 -  Appointment to be done though in an open manner by involving public in search process


How appointment was done in Uttarakhand Lokpal (which was appreciated by team Anna)
The Selection Committee shall consist of the following:-

(i) The Chief Minister of Uttarakhand, who will be the chairperson of search committee.
(ii) The Leader of the Opposition in the Legislative Assembly 
(iii) Two judges of the Uttarakhand High Court selected by 
(iv) One person from previous Chairpersons of Lokayukta (
(v) Two members shall be selected by the other members of the 
Selection Committee [(i) to (iv) above] 


What's proposed in Delhi Govt. Bill in 2015 Regarding appointment
Lieutenant Governor shall, appoint a three member body having one Chairperson and two Members to be known as the Janlokpal.
Provided that –
(a) the Chairperson and members of the Jan lokpal shall be appointed on the basis of the recommendation of a Selection Committee consisting of-

(i) The Chief Justice of the High Court – Chairperson.
(ii) The Chief Minister of Delhi – member.
(iii) The Leader of the Opposition in the Legislative Assembly and if there is no such leader, a person  
selected in this behalf by the Members of the Opposition in that House in such manner as the Speaker may direct - member.
(iv) The Speaker of the Legislative Assembly – member

(b) No appointment of the Chairperson or a member of the Janlokpal shall be invalid merely by reason of any vacancy in the Selection Committee. 

(c) The Selection Committee shall regulate its own procedure for selecting the Members of the Janlokpal.

(d) The recommendation of the Selection Committee shall be binding on the Lieutenant Governor who shall
make the concerned appointment to the Janlokpal no  later than thirty days from the date of receipt of the
recommendation of the Selection Committee.

(2) A person shall not be qualified for appointment as –

(a) as Chairperson of the Janlokpal, unless he is or has been a judge of the Supreme Court or Chief Justice of any High Court in India, or a Judge of a High Court.

(b) a Member, unless such person is a person of eminence having obtained distinction, special knowledge and expertise 
in public administration, finance or investigation. 

(3) Every person appointed as a Chairperson or a Member of the Janlokpal shall, before entering upon his office, make and 
subscribe before the Lieutenant Governor or some person appointed in that behalf by him, an oath or affirmation in the form
as prescribed by the Government under the Rules.

The center's Lokpal passed in 2013 - Which was termed as Jokepal 


The Chairperson and Members shall be appointed by the President after obtaining the recommendations of a Selection Committee consisting of —

(a) the Prime Minister—Chairperson;
(b) the Speaker of the House of the People—Member;
(c) the Leader of Opposition in the House of the People—Member;
(d) the Chief Justice of India or a Judge of the Supreme Court nominated by him—Member;
 (e) one eminent jurist, as recommended by the Chairperson and Members

referred to in clauses (a) to (d) above, to be nominated by the President—Member.

Now, let's see what original Lokpal bill 2011 for which Anna andolan happened


“Lokpal Bench” means a Bench of 2 or more members of the Lokpal acting together in respect of any matter in accordance with the regulations. Each bench  shall have a member with legal background.
(6) The Selection Committee shall consist of the following:-
(i) The Prime Minister of India, who will be the Chairperson of the Selection Committee.
(ii) The Leader of the Opposition in the Lok Sabha
(iii) Two judges of Supreme Court of India and two permanent Chief Justices of the High Courts selected by collegium of all Supreme Court judges

(v) The Chief Election Commissioner of India 
(vi) The Comptroller & Auditor General of India
(vii) All previous Chairpersons of Lokpal.

Before sending the short list to the Selection Committee, the Search Committee will get the names of the short listed persons put on a public web site to enable  people to send any relevant information/comments about the shortlisted persons.


Conclusions, (What we see in above references)



Conclusion 1 
Delhi Bill Conforms to minimum members of Lokpal
- First of all, Delhi Lokpal bill 2015 conforms to original lokpal's number of members. Which is more than 2, that means 3 in a state like Delhi it is sufficient. 

Conclusion 2 About Public opinion/participation
Public opinion is not sought in Delhi's Lokpal 2015

In original lokpal bill 2011 as suggested by team Anna,  following provision was there. But it is not there in Delhi Lokpal. 

- Secondly, Before sending the short list to the Selection Committee, the Search Committeewill get the names of the short listed persons put on a public web site to enable people to send any relevant information/comments about the shortlisted persons.

Suggestion:
I think Delhi assembly must add this procedure. People should be able to raise issues if there is any problem in suggestions

Modi interview observations

Narendra Modi interview Aaj Tak observation:

Question:  Congress questions your ministers like Bokhariya?

Modi Answer:  Court has given stay to him. Congress has to right to ask us because it itself has corrupt ministers.

Observation: So if a party has corruption minsters (which are under similar to Bokhariya) should not raise corruption issues against your ministers?


Question: Gave land to Adani.. for cheap?
Modi Answer: (gets furious for this question) says i will give you a PPT and you show it on TV then u will understand.
Observation: Why can't you give answer in a live interview?


Question: Snoopgate investigation?
Modi: No explanation given on case, and only said that its a conspiracy to malign him.

Observation: I think a politician must be ready with details and give answers rather than just saying that its a conspiracy.

Question : On Pakistan?
Modi: We should not show eyes, not see eyes.

Observation: Ambiguous answer. Usually Modi supporters criticize

Positive points:
Use of technology to reduce corruption .He advocates use of technology, which is a good thing.

BUT
It will reduce corruption at lower levels He does not talk about how to eradicate corruption at higher levels with stricter laws like Janlokpal. Most of his promises are ambiguous and say good things but does not show measures to bring results.

U turns or sacrifice ? You decide!


A man who takes U-turn for others is not cheating but sacrificing!
I have nothing but RESPECT for such U-Turns!


If Kejriwal was such a strategist (as many friends from BJP claim) or hungry for seat, he would have never formed government in Delhi.


A little poem:
Arjun said he will never attack his cousins...
But situation led him to do so!

I said i will never get married,
But when i saw my mother's eyes full of expectations
i could nt leave marriage proposals and go...
A doctor said he will never work in a village
But he stayed, when he saw dying poor children...
Would you call it a U-turn, No?

Yes promises should not be broken but
can we stick to stubborn attitude for everything?

What's more important, symbolic actions..
Or humble reactions?

Because stubborn are rocks
they  cause friction and damage
But the water takes U-turns and
flows with all its humbleness...

That's what our religion teaches
Be humble! Don't be adamant..

Extreme of either thing is wrong...
No matter if you take U-turns or break promises..

Respect opinions of your friends..
Till it keeps your integrity clean and strong!

Is taking U-Turns wrong?

We all take U-turns. You cannot predict future 100%, when you start on a journey you make plans and promises but if the road has a U-turn driving , you will HAVE TO change the gear and rotate the steering and take a U-Turn!




Each and every of Arvind's U-Turns is an act of humbleness. How many politicians do we see who act on requests from people?


Arvind Kejriwal is accused of taking U Turns. But has he compromised on his integrity? I doubt so.. and that's precisely the reason why i think those U-turns are not cheats but act of humbleness and sacrifices.

YOU CALL IT U-Turns I call it SACRIFICE OF PERSONAL THOUGHTS FOR OTHER's BELIEFS!
