Election Commission notice on muslim letter

While i am not an law expert,  I have a few comments and thoughts on new notice raised on AAP by election commission regarding:




The Code para 3 says
"There shall be no appeal to caste or communal feelings for securing votes.

"Mosques, churches, temples or other places of worship shall not be used as a forum for election propaganda."

It is clearly states caste and communal feelings. I think this is a very good and valid rule that should be applicable on all political parties in India. 

 I strongly support this law and i am sure Aam Aadmi Party must not have intended to violate it.  In fact AAP itself detests the fact that votes get divided on the basis of religion and caste.

I wish we had a political system in India where religion and caste was not the driving reason to garner votes from people. We read several news and statistical reports which say that more than 80% votes are

Coming to the issue of letter by Arvind.

Here are some of my observations regarding the whole issue


  • Rarely there goes any speech where both Congress or BJP do not talk about caste and religion during their speeches.



  • Here in above video Amit Shah talking about Ram Mandir to be built if BJP comes to power. And also not just him but the party leaders also support his view.

  •  Not evading the genuine questions raised by election commission Now i do not want to evade as an AAP supporter just by saying that others do it so we will do it too! That should not be the style of new wave politics like AAP and its supporters.

    So here are some of the points I would like to make:
  • AAP's letter is not "Aggravating differences"
    "The model code prohibits speeches that aggravate differences between religious communities and restrains politicians from criticizing rival parties based on unverified allegations."
    The letter was not written to create any hatred or rift amongst any communities. Only to create awareness of the corruption rampant in the society. It was very similar to other letters written to businessmen and 
  • Why call BJP communal?

     I am sure the allegation that BJP is communal was in reference to the recent riots where BJP MLA were charged for inciting riots.

    I think guidelines say that no comment can be made without proof, so is referring to latest issues not a violation based on this logic.

    No part of the letter says anything to 'aggravate communal hatred' Or to create differences amongst people. Its main intention is to appeal to voters is not against BJP but against Congress and corruption. 

    It intends to say that vote for a party that promises you development. One thing which every good politician have been telling the country.

    The day people start voting for development and work, i am sure 90% of the dirt in politics would be removed off! This is what this letter meant to say in general context!

So in my humble opinion. The violation rule is very subjective. So it depends upon  the honorable members of the EC on how they look at this matter. But i am writing my thoughts on this matter. These of course are not official statement from AAP as i am not an official spokesperson of the party.

I am sure,  a decision in favor of Aam Aadmi Party will be given which is the first party that is asking for votes to eradicate current system of caste/votebank politics.
